If there is community property, both parties must agree on how to divide the property. If there are children, then the parties must agree on all issues concerning the children.
Contested Without Minor Children
The only real issue in these types of divorces is the division of property. An attorney will review the couples assets and classify them to determine the value of the community estate. Most courts will require the couple to attempt to come to an agreement. If an agreement is not reached, then it is up usually up to the judge to make a fair and equitable division of the community estate.
Contested With Minor Children
When children were born during the marriage, even if the child's father is not the same as the husband, the divorce must also dispose of any issues dealing with the children. The more parties are involved the more complex the case becomes.
