Driver's License Suspension
You are damned if you do, damned if you don't. When you are stopped and the police officer suspects that you are intoxicated you will inevitably be asked to provide a sample of your breath. If you refuse, your driver's license will be suspended for a period of 180 days. If you decide to provide a breath sample and the breath sample is above a .08 your license will potentially be suspended for 90 days.
Possible Loss of Freedom
It is a possible loss of freedom for up to a year in the county jail for a the first misdemeanor DWI charge. Other factors such as having a child less than fifteen (15) years of age in the vehicle will elevate the charge to a felony level charge where the loss of freedom could be years.
Surcharges
If you receive a final conviction for DWI, the state will charge you to keep a current and active driver’s license. They will bill you yearly for three years as follows:
DWI 1st - $1,000
DWI 2nd - $1,500
DWI with BAC ≥ 0.16 - $2,000
